"Intracompany Transferee"

"Intracompany Transferee" or /ki-gyo-nai-ten-kin/ in Japanese is one of "Status of Residence" defined by Japanese immigration law.

Activities that can be carried out under the status of residence "Intracompany Transferee"

Activities that can be carried out under the status of residence of "Intracompany Transferee" are the same as activities that can be done with the status of residence of "Engineer/Specialist in Humanities/International Services" and can be broadly divided into three.

技術... Activities engaged in work that requires skills or knowledge belonging to the fields of science, engineering and other natural sciences

人文知識... Activities engaged in work requiring knowledge belonging to the fields of law, economics, sociology and other humanities

国際業務... Activities engaged in work requiring thought or susceptibility based on foreign culture

Persons qualified for "Intracompany Transferee"
- transferred to the Japanese branch (head office of the same company, etc.)
etc.

If you are engaged in research work, you may fall under the status of residence of "Researcher".

Requirements for "Intracompany Transferee"

In order to be recognized as an "Intracompany Transferee" status of residence, the following requirements must be satisfied.

The provisions of the period

The status of residence of "Intracompany Transferee" is a requirement to "establish a period for transfer" to a place of business located in Japan. Although this does not interfere with the renewal procedure, it is necessary for the relocation orders, declaration orders, etc. to clearly indicate the period of service at the office located in Japan.

Work requirement for the last year

Be engaged in the business of "Engineer/Specialist in Humanities/International Services" at a head office, branch office or other business establishment located in a foreign country immediately before the transfer relating to the application.

That period must last for more than one year. (* If there is a period during which you are engaged in business at a place of business in Japan of a public or private institution with a business establishment in a foreign country with a status of residence of "corporate transferee", the period is the sum total of that period)

Period of Stay

"Period of Stay" will be determined among one of the followings.
5-year, 3-year, 1-year or 3-month.

Spouse and Children

Spouse and/or Children of a person who is staying in Japan under the status of "Intracompany Transferee" will be qualified for the status "Dependent".

本邦において行うことができる活動（出入国管理及び難民認定法　別表第一　二）

Activities on the part of a personnel who is transferred to a business office in Japan for a limited period of time from a business office established in a foreign country by a public or private organization which has a head office, branch office or other business office in Japan and who engages at this business office in the activities listed in the right-hand column of the "Engineer" and "Specialist in Humanities/International Services" columns of this table.

本邦に本店、支店その他の事業所のある公私の機関の外国にある事業所の職員が本邦にある事業所に期間を定めて転勤して当該事業所において行うこの表の技術の項又は人文知識・国際業務の項の下欄に掲げる活動

Ministerial Ordinance to Provide for Criteria Pursuant to Article 7, paragraph (1), item (ii) of the Immigration Control and Refugee Recognition Act
基準（出入国管理及び難民認定法第七条第一項第二号の基準を定める省令・省令第十六号）

The applicant must fulfill all of the following requirements.
(i) The applicant must have been employed at the main office, branch office, or other office outside of Japan for at least 1 year immediately prior to his/her transfer to Japan, during which time he/she was engaged in duties which fall under the categories of "Engineer" or "Specialist in Humanities/International Services" as listed in the right-hand column of Appended Table I (2) of the Immigration Control Act.
(ii) The applicant must receive no less remuneration than would a Japanese national for comparable work.

申請人が次のいずれにも該当していること。
一　申請に係る転勤の直前に外国にある本店、支店その他の事業所において一年以上継続して法別表第一の二の表の技術の項又は人文知識・国際業務の項の下欄に掲げる業務に従事していること。
二　日本人が従事する場合に受ける報酬と同等額以上の報酬を受けること。

(i) Document indicating the relationship between the business offices in the foreign country and in Japan.
(ii) Certificate of matters entered in the registry, a copy of the profit and loss statement and a material certifying the contents of business of the business office in Japan.
(iii) Document certifying the contents of duty and employment period at the business office in the foreign country.
(iv) Certificate of matters entered in the registry of the business office in the foreign country and a material certifying the office's outline.
(v) Document certifying the contents and period of the activities and the alien's position and reward.
(vi) Graduate certificate and a document certifying the alien's background.

二　本邦の事業所の登記事項証明書、損益計算書の写し及び事業内容を明らかにする資料
